Possibly not. See, this is why it's dangerous for the prosecution to question a suspect directly - because any questions they ask can make inferences or pre-judgements that become grounds for objections. Like they can't ask Chiaki directly if she purposely caused a prisoner release.

Liu Xi is different, because they haven't yet built a jail that can hold her permanently. She can modify the materials prisons are made of, or simply create herself an exit. It may be decided that given the magnitude of her crime, the only way is if she's dead.

And then there's the fact that one of the people she killed isn't from Earth. If she's allowed to live, it might create an intergalactic incident, or a war.

That actually might be what makes Hatman wary of trying: Because the criminal justice system doesn't have any experience with someone like Liu Xi. Fear may be what prevails instead of justice.

Right now Liu Xi and her power exists under the radar of most governments and police. If she ever became the focus of their attention, it's pretty certain they'd make decisions based on fear, and she'd be hunted to kill much like Danny Lyle was.
