They'd pretty much have to be tested individually. There could be a 30-year old robot out there whose intelligence is capped at a minimal level, too.

Machines would need much more stringent tests, simply because humans have had thousands of years to figure it out. Before humans figured it out, they had primitive "rites of passage" to prove that they were mature enough to handle adult things. That's pretty much where it will have to start with machines, only less standardized.
