Akiko gets a sort of "special pass" with the Legion due to her association with Visionary. As to occasionally associating with the criminal element, other characters have underworld connections (I'm sure Yuki has a snitch or two, as did DK, etc).
But engineering a prison break of the most concentrated population of incarcerated supervillains, especially when the city and world is this vulnerable, she went too far this time.
